Supreme Court blasts DA Larry Krasner\u2019s office, says it misleads judges when seeking to vacate old murder convictions"},"content":{"rendered":"<div>\n<div>\n<div><audio><\/audio><\/div>\n<\/div>\n<p>In a forceful and scolding opinion, the Pennsylvania Supreme Court ruled Tuesday that District Attorney Larry Krasner\u2019s office misled the courts, \u201cviolated its duty of candor,\u201d and submitted false statements when asking a judge to vacate a 2004 murder conviction.<\/p>\n<p>Read more <a href=\"https:\/\/corporate-movers-usa.com\/?p=1110\">Trade grade: Flyers take a step forward by upgrading the backup goalie spot with acquisition of Joseph Woll<\/a><\/p>\n<div><\/div>\n<p>In the opinion released Tuesday, Justice Kevin Dougherty wrote that prosecutors\u2019 pattern of misleading judges in seeking to overturn murder convictions is so troubling and recurrent that, going forward, before Krasner\u2019s office seeks such relief, judges must notify the state attorney general\u2019s office and allow it to review the case.<\/p>\n<div><\/div>\n<div><\/div>\n<p>The decision amounted to one of the most scathing rebukes yet of Krasner\u2019s efforts to revisit decades-old convictions, and arrives amid intensifying scrutiny of the office\u2019s Conviction Integrity Unit and appeals division, whose handling of post-conviction cases has drawn criticism from judges in both state and federal court. <\/p>\n<div><\/div>\n<p>Just last week, Krasner\u2019s office reversed course in a separate murder case, writing in a federal court filing that one of its prosecutors made \u201cmaterial misstatements\u201d and submitted \u201clegally erroneous\u201d statements when seeking to overturn a man\u2019s murder conviction. The office sought to withdraw its recommendation to grant the defendant a new trial.<\/p>\n<div><\/div>\n<p>And in December, a panel of federal judges voted to disbar a supervisor in the office\u2019s appellate unit, saying he \u201clied repeatedly\u201d while seeking to overturn the death sentence of a man who killed a couple inside their East Mount Airy home, then left their infant daughter inside to die.<\/p>\n<div><\/div>\n<p>By giving the state attorney general authority to intervene when Philadelphia prosecutors decline to defend a conviction, the high court added a new layer of oversight to the state\u2019s largest prosecutor\u2019s office \u2014 a rare step that reshapes who controls post-conviction litigation in Pennsylvania. <\/p>\n<div><\/div>\n<div><\/div>\n<p>Krasner\u2019s office did not immediately respond to a request for comment Tuesday.<\/p>\n<div><\/div>\n<p>While four justices \u2014 Dougherty, Sallie Mundy, P. Kevin Brobson, and Daniel McCaffery \u2014agreed there are systemic concerns about the district attorney\u2019s office, three \u2014 Debra Todd, Christine Donohue, and David Wecht \u2014 supported neither that narrative nor the court\u2019s remedy.<\/p>\n<div><\/div>\n<p>Wecht cast the lone full dissent, arguing that the case did not warrant the Supreme Court\u2019s intervention and that the lower courts already have the tools necessary to prevent improper concessions by prosecutors.<\/p>\n<div><\/div>\n<p>The case at the center of the court\u2019s ruling was that of Lavar Brown, who was sentenced to life in prison without the possibility of parole after a jury convicted him of second-degree murder in the robbery and shooting death of Michael Richardson, a North Philadelphia Rite Aid worker, in 2003. <\/p>\n<div><\/div>\n<div><\/div>\n<p>Brown was later convicted of shooting and killing a second man, Robert Crawford, in 2005, and was sentenced to death \u2014 in part because of the first conviction.<\/p>\n<div><\/div>\n<p>In post-conviction court filings, Brown\u2019s attorneys said the prosecution\u2019s case largely relied on the testimony of two witnesses \u2014 including one who, in a statement to police, implicated a teenage girl who was incarcerated at the time of the murder. The witness\u2019 earlier statements were never provided to his trial lawyers, the attorneys said, which violated his right to a fair trial.<\/p>\n<div><\/div>\n<p>In 2021, Krasner\u2019s office said Brown should be granted a new trial, arguing his case had been \u201cinfected by serious misconduct\u201d by past prosecutors. <\/p>\n<div><\/div>\n<p>When a Common Pleas Court judge later granted Brown a new trial, the families of Richardson and Crawford took the unusual step of asking Pennsylvania\u2019s highest court to intervene. <\/p>\n<div><\/div>\n<div><\/div>\n<p>The families said Krasner had a conflict of interest because two of his former law partners had previously been involved in Brown\u2019s case. They also argued the DA\u2019s office was trying to \u201ccircumvent\u201d the courts by conceding relief in the Rite Aid killing, which had served as an aggravating factor for his death sentence.<\/p>\n<div><\/div>\n<p>The Supreme Court agreed to hear arguments in March 2025. And on Tuesday, six justices agreed Brown\u2019s conviction should stand.<\/p>\n<div><\/div>\n<p>Dougherty, in writing the majority opinion, was scathing in his assessments of prosecutors\u2019 conduct. <\/p>\n<div><\/div>\n<p>In a case involving a murder conviction and death sentence, he wrote, the district attorney\u2019s office\u2019s \u201cfidelity to its duty of candor should have been at its zenith. Regrettably, it was anything but.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/corporate-movers-usa.com\/?p=1108\">Future hall of fame MLB owner planted ivy at Penn on this week in Philly history<\/a><\/p>\n<div><\/div>\n<div><\/div>\n<p>The opinion said prosecutors did not disclose a memorandum in which a key witness, Ronald Vann, identified Brown as being involved in the murder, even as they asked Common Pleas Court Judge Glenn Bronson to vacate the conviction. <\/p>\n<div><\/div>\n<p>Instead, the court said, they asserted that document was irrelevant to Brown\u2019s claims.<\/p>\n<div><\/div>\n<p>Krasner\u2019s office also tried to keep the victim\u2019s families from accessing it.<\/p>\n<div><\/div>\n<p>But the memorandum was \u201cunquestionably relevant\u201d to the case and showed a consistency over time of Vann\u2019s statements, the opinion said. That Krasner\u2019s office would say otherwise \u201crings hollow and smacks of post hoc rationalization,\u201d the justices wrote.<\/p>\n<div><\/div>\n<p>\u201cThe memorandum would have poured salt on the \u2018fertile ground\u2019 for impeachment envisioned by the DAO,\u201d they said, adding that withholding the document was a \u201cbreach of its duty of candor\u201d to the court.<\/p>\n<div><\/div>\n<p>The high court also said prosecutors filed a joint stipulation with Brown\u2019s attorneys that \u201cwas false in multiple respects,\u201d including mischaracterizations of the timeline of witness statements to police.<\/p>\n<div><\/div>\n<p>The justices said prosecutors had not interviewed a single witness or investigator who\u2019d handled the case, and rejected their claims that it had conducted a \u201cthorough, independent review of the records in this case.\u201d Krasner\u2019s office, they wrote, \u201ccut corners and shirked its duties in conducting its post-conviction \u2018investigation.\u2019\u201d<\/p>\n<div><\/div>\n<p>They reversed Bronson\u2019s order granting Brown a new trial. <\/p>\n<div><\/div>\n<p>To \u201cpromote just outcomes\u201d moving forward, the opinion said, the courts handling appeals must notify the attorney general\u2019s office of any case in which Krasner\u2019s office plans to seek relief, and give state prosecutors the opportunity to review it and weigh in on whether the decision is appropriate.<\/p>\n<div><\/div>\n<p>A lawyer for Brown could not be reached for comment.
